《儿童抚养义务法律适用公约》1956年第8届海牙国际私法会议制定的、 规定儿童抚养涉及两国或几个国家时的共同法律适用规则。公约于1956年10月24日公开签字，截至1983年3月1日，批准国有联邦德国、奥地利、比利时、西班牙、法国、希腊、意大利、 日本、 卢森堡、挪威、荷兰、葡萄牙、瑞士、土耳其。加入国有列支敦士登。1962年开始生效。在现代生活中，人的流动性较大，对儿童负有抚养义务的人,有时远在他国,有时甚至前往外国以逃避责任，儿童抚养义务在一些国家中成为迫切的国际问题。为此，有关的国际机构就这个问题成立了一些公约，主要有第8届海牙国际私法会议通过的两个公约,即《儿童抚养义务法律适用公约》及1958年公开签字的《儿童抚养义务决定的承认和执行公约》，后一公约保障前一公约的执行。此外,1956年6月20日在联合国主持下制定了《国外扶养费收取公约》,规定国外扶养费收取的办法,这个公约可以帮助海牙公约的实施。海牙国际私法会议在1972年第12届会议中，又制定了范围更广的《扶养义务法律适用公约》,及《扶养义务决定的承认和执行公约》,新公约适用于全部家庭关系的扶养义务，包括儿童抚养义务在内。在批准新公约的国家间，新公约代替1956年及1958年的儿童抚养义务公约。1956年的《儿童抚养义务法律适用公约》适用于对21岁以下未结婚的青少年和儿童的抚养，包括婚生子女、非婚生子女及养子女在内。但对于养子女，缔约国在签字批准或加入公约时，可以保留不适用公约的规定。公约不适用于旁系亲属间的扶养关系。公约采取互惠原则，以互相承认法律适用为条件，根据公约规定所应当适用的法律如为非缔约国的法律即不适用。公约只规定抚养义务，并不决定抚养义务人及抚养权利人间亲属关系的存在，例如对非婚生子女的抚养并不因此当然成立亲子关系。《儿童抚养义务法律适用公约》一反过去以义务人属人法为主导的思想，出于保护儿童目的，以儿童惯常居所地法支配儿童抚养义务。这个法律决定儿童抚养义务的存在、范围、抚养义务人、有权提起抚养诉讼的人及起诉期限等，儿童惯常居所地变更时，变更后的关系适用新惯常居所地法。对儿童惯常居所地法的适用有两个例外：①在下列情况下缔约国可适用当事人本国法:(a)抚养义务人与儿童有同一国籍，(b)诉讼由该国受理，(c)抚养义务人的惯常居所在该国。②为了保护儿童的利益，在儿童依惯常居所地法不能取得任何抚养权利时，则适用法院地国际私法所指示的法律。根据公约规定所应当适用的法律明显地违反法院地国的公共秩序时即不适用。
